A proposed executive action targeting birthright citizenship challenges a long-standing principle of how the United States has defined belonging since 1868.

By linking a newborn’s legal status to the immigration standing of their parents, it would shift the line between who is automatically included and who is not—starting from birth itself. While undocumented families would be directly impacted, the effects could also reach those on student, work, or temporary visas who have complied with existing regulations.

The legal response has been swift and intense. More than twenty state attorneys general have argued that the 14th Amendment to the United States Constitution is clear in its promise, cautioning that such a move could create a lasting group of individuals born in the country but denied full recognition. As the Supreme Court of the United States considers the issue, the implications go well beyond immigration policy. At stake is whether the nation will uphold a post–Civil War commitment to equal citizenship, or allow shifting political priorities to reshape who is recognized as fully belonging.
